BASED ON POLICY NUMBER AND TITLE: 8-11-0 Age Discrimination Policy
PURPOSE: To provide a prompt and equitable process for resolving complaints alleging age-based discrimination in violation of the Age Discrimination Act of 1975 (Age Act) and its implementing regulations, 34 C.F.R. Part 110.
Scope
This procedure applies to all complaints by students or applicants for admission alleging discrimination based on age in any of Trident Technical College’s programs, services, or activities.
Filing a Complaint
- Complaints must be submitted in writing via the Discrimination Complaint Form to the Age Discrimination Act Coordinator within 180 calendar days of the alleged discriminatory act.
- Complaints should include the complainant’s name, contact information, description of the alleged act(s), and date(s) of occurrence.
Informal Resolution
- The Coordinator may attempt informal resolution when appropriate and agreed to by the complainant.
- Informal resolution will not extend the timeframe for completing the formal grievance unless both parties agree in writing.
Formal Grievance Procedure
- Acknowledgment: The Coordinator will acknowledge receipt of the complaint in writing within 10 business days.
- Investigation: The Coordinator or designee will conduct an impartial investigation, including witness interviews, document review, and evidence collection.
- Determination: Within 60 calendar days of receiving the complaint, the Coordinator will issue a written determination summarizing findings, conclusions, and corrective/remedial actions, if any.
- Notice: The determination will be provided to the complainant and relevant College officials.
- Appeal: The complainant may appeal the determination within 10 business days to the Vice President for Student Services. A final written decision will be issued within 30 calendar days.
Recordkeeping
Records of all complaints, investigations, and resolutions will be retained for a minimum of three (3) years.
Non-Retaliation
Retaliation against any individual who files a complaint or participates in an investigation is strictly prohibited.
