Purpose

Trident Technical College (“the College”) is committed to maintaining an educational environment free from unlawful discrimination. In furtherance of this commitment, the College adopts this policy to adhere to, enforce, and fully comply with the Age Discrimination Act of 1975, as amended, and its implementing regulations at 34 C.F.R. Part 110 (“Age Act”).

The College prohibits discrimination on the basis of age in any of its programs, services, activities, admissions practices, or employment-related student programs, except as permitted by law.

This policy applies to:

  • All students and applicants for admission;
  • All College programs, services, and activities receiving federal financial assistance; and
  • All College employees, administrators, and agents involved in the administration of College programs or services.

The College shall not:

  • Exclude any person from participation in;
  • Deny any person the benefits of; or
  • Subject any person to discrimination

on the basis of age, except where age distinctions are expressly permitted by federal law or regulation.

The College shall maintain and implement a separate, prompt, and equitable Age Discrimination Act Complaint Procedure consistent with 34 C.F.R. Part 110, said procedure shall be 8-11-1.

Complaints alleging discrimination on the basis of age that trigger this Policy shall be processed exclusively under the Age Discrimination Act Complaint Procedure and shall not be subject to the College’s general Student Grievance Procedure.

Nothing in the College’s grievance or appeal processes shall be interpreted to limit, delay, or require exhaustion of a complainant’s rights under the Age Act.

Retaliation against any individual for filing a complaint, participating in an investigation, or opposing practices prohibited by the Age Act is strictly prohibited. Any act of retaliation shall constitute a separate violation of College policy and may result in disciplinary action.
